Francqui chair prof. dr. Paul Lemmens: Human Rights in Europe: challenges (Research)

Abstract

The European Convention on Human Rights guarantees a number of fundamental rights. It has also provided for the establishment of the European Court of Human Rights (ECtHR) in Strasbourg. However, the protection of fundamental rights is not just the task of this Court alone: the primary responsibility to guarantee and safeguard human rights lies with the national authorities and, in particular, the national courts. Paul Lemmens, emeritus professor at the KU Leuven and former judge at the ECtHR, discusses the specific role of the Court, considered in relationship with that of the national authorities. Close cooperation between national judges and the European Court is necessary in order to meet the many challenges the European human rights system faces today. What does this cooperation look like? What are the challenges?
